SERVICE AGREEMENT
BZsquare.com provides web hosting space renting and its relative services. All subscriber must agree and follow all rules below
• Rights
BZ will host an account for you, the purchaser (hereafter referred to as the Account Holder), for the Account Holder's chosen domain name, for the period of time (the Term) corresponding with the payment plan chosen by the Account Holder. This contract will be automatically renewed at the end of the Term and each successive renewal term, unless terminated. We require notification of non-renewal by fax or postal mail with a minimum of 30 days notice prior to your renewal date. Phone or e-mail notification is not acceptable. If you do not provide this notice, your account will be renewed. There are no refunds on a la carte services, dedicated servers or server collocation.
• Customer Responsibility
a) Customers are required to use the BZ's service responsibly. This includes respecting the other customers of BZ. BZ reserves the right to suspend and/or cancel service with any customer who uses the BZ's service in such a way that adversely affects other BZ customers. BZ anticipates that customers who offer Internet services will cooperate with BZ in any corrective or preventive action that BZ deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of BZ 's policy and BZ reserves the right to take any such action.
b) Subscribers should provide accurate and updated personal or company information during application. Subscribers are responsible to inform BZ any changes of contact details such as email, telephone and fax number. BZ reserves the rights of account suspension and termination to the subscribers without prior notices when BZ cannot contact the subscribers.
c) Subscribers have responsible to keep all their accounts and password information secret and normal including:
i) To inform BZ immediately for any abnormal or unauthorized login;
ii) To keep track of the account movement or usage;
iii) To perform a complete logout for a login.
d) Responsibility for Content : You as a BZ's Hosting Customer, are solely responsible for the content stored on and served by your BZ Hosting account.
• Web Site Contents and Data
The Web Site Hosting account and/or related electronic services can only be used for legal purposes under all applicable international, federal, provincial, and municipal laws. Further, the Account Holder agrees not to store, transmit, link to, advertise or make available any images containing pornography. Violations of these or any other provisions of this Agreement may result in termination of the services provided by BZ, with or without the grant of a notice or cure period, such notice or cure period to be granted at the sole discretion of BZ based upon the severity of the violation. BZ reserves the right to refuse service if any of the content within, or any links from, the Account Holder's website is deemed illegal, misleading, or obscene, or is otherwise in breach of BZ's then current Acceptable Use Policy, in the sole and absolute opinion of BZ. Notwithstanding anything in this Agreement, the content of the Account Holder's website is the sole responsibility of the Account Holder. The Account Holder agrees to indemnify and hold harmless BZ from any and all claims, losses, damages, liabilities, judgments, or settlements, including reasonable attorney's fees, costs, and other expenses incurred by BZ, (collectively, Claims) related to or in connection with the content of the Account Holder's website. The terms of this Section will survive any termination of this Agreement.
• Service Abuse
BZ reserves the rights to refuse, suspend or terminate service to subscribers whose service usage may jeopardize server performance and resources such as execute a huge amount of programs, sending a huge amount of emails, abuse of bandwidth and server resources which may affect the regular service to other subscribers. BZ will suggest that subscribers to transfer to a dedicated server package at our sole discretion.
• Suspension of Account
BZ reserves the right to suspend network access to any customer if in the judgment of the BZ administrators the customer's web hosting account or server is the source or target of the violation of any of the terms of service, the TOS, or for any other reason BZ chooses. If inappropriate activity is detected, all accounts of the customer in question will be deactivated until an investigation is complete. Prior notification to the customer is not assured. In extreme cases, law enforcement officials may be contacted regarding these activities. The customer will not be credited for the time the customer's service is suspended.
• Termination
Without prior notice and without prejudice to such other rights as BZ.com may have, BZ.com may terminate or suspense the E-Mail Services or this Term Sheet for any reason in its sole discretion, if the Customer breaches or fails to comply with any term of this Term Sheet and in such event all Charges paid shall not be refunded and the Customer is not entitled to claim against BZ.com for the return of the Charges (or any part thereof).
Any termination or suspension shall not affect any accrued rights of BZ.com or liabilities of the Customer nor shall it affect the coming into force or the continuance in force of any provision contained in the Agreement or this Term Sheet which is expressed to survive the Agreement or this Term Sheet, which shall remain in full force and effect.
• Modification
BZ reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
